Should I Refuse to Take a Field Sobriety Test?
If you've been pulled over under the suspicion of a DUI, it's likely that the officer will ask that you agree to a field sobriety test. While the officer may not share this important bit of information, these tests are voluntary – under no circumstances are you legally obligated to agree to a field sobriety test if you are not in police custody.
If you are pulled over, you should do the following:
- Provide the officer with your license, registration, and proof of insurance
- Step out of the car, but only if you've been asked to
- Avoid engaging in conversation – you do not have to answer questions such as, "have you been drinking?"
Although you may be encouraged to take a field sobriety test in an effort to show the officer that you're innocent, these tests are designed to prove guilt. Agreeing to a field sobriety test does not necessarily guarantee an escape from arrest – there is always the possibility that the officer places you under arrest if they find one small error in your sobriety test.
